Terms & Conditions of Service

1. Definitions and Interpretation

1.1 The following definitions apply:

  • “Muck Away”: Muck Away Total Cleaning Solutions Limited, registered in England & Wales, company number 13232183, including its employees, agents, and subcontractors.
  • “Customer”: The person, firm, or company purchasing Services from Muck Away.
  • “Services”: Any carpet cleaning, upholstery cleaning, rug cleaning, rug spa services, hard floor cleaning, carpet repair, carpet dyeing, advanced stain removal, colour correction, or related treatments provided by Muck Away.
  • “Contract”: The agreement between Muck Away and the Customer incorporating these Terms.
  • “Start Date”: The earlier of (i) the date the Customer accepts these Terms (including online or verbal acceptance), or (ii) the date Muck Away commences the Services.
  • “Goods”: Any materials, cleaning products, or accessories supplied by Muck Away.
  • “Pre-Existing Damage”: Any wear, defects, fading, sun damage, fibre weakness, loose threads, prior repairs, or previous cleaning/dyeing issues present before the Start Date.

1.2 References to legislation are to that legislation as in force at the relevant time.

1.3 Words in the singular include the plural and vice versa.

2. Application of Terms

2.1 These Terms apply to all Services provided by Muck Away and prevail over any inconsistent terms supplied by the Customer.

2.2 By booking or accepting Services, the Customer agrees to be bound by these Terms.

2.3 No variation is valid unless agreed in writing by a director of Muck Away.

3. Services Provided

3.1 Muck Away provides the following professional services:

  • Carpet cleaning
  • Upholstery cleaning
  • Hard floor cleaning
  • Rug cleaning and Rug Spa services
  • Carpet repair
  • Carpet dyeing
  • Advanced stain removal and colour correction

3.2 All necessary equipment and materials are provided by Muck Away.

3.3 Customers must supply safe access to electricity and hot running water at the premises.

4. Scope and Limitations of Services

4.1 Muck Away will perform the Services with reasonable skill and care in accordance with industry standards.

4.2 No guarantee is given for complete removal of stains, odours, or defects. Some stains, including but not limited to dyes, inks, pet urine, tanning agents, burns, or chemical spills, may be permanent.

4.3 Treatments such as advanced stain removal, colour correction, bleaching, or dyeing carry inherent risks, including colour loss, fibre distortion, texture change, shrinkage, or further visible damage. The Customer accepts these risks and Muck Away shall not be liable.

4.4 Services may reveal Pre-Existing Damage or hidden defects not visible prior to treatment. Muck Away accepts no liability for such issues becoming apparent.

4.5 Repairs and dyeing are performed to the best of our ability but may not perfectly match the original fibres in colour or texture.

4.6 Any estimated times for completion are not guaranteed and shall not be of the essence.

5. Customer Obligations

5.1 The Customer shall:

  • (a) Provide safe and unobstructed access to the premises and items.
  • (b) Remove fragile, valuable, or breakable items before work begins.
  • (c) Vacuum carpets before arrival unless otherwise agreed.
  • (d) Inform Muck Away of any previous treatments, products used, or known issues.
  • (e) Ensure items are free from infestation, hazardous substances, or biohazards unless disclosed and agreed.
  • (f) Notify Muck Away if furniture or items require moving; Muck Away reserves the right to refuse to move items.
  • (g) Sign any required high-risk treatment waiver.

5.2 Failure to comply with these obligations may result in refusal of service, delays, or additional charges.

6. Safety and Right to Refuse Work

6.1 Muck Away reserves the right to refuse or suspend Services where:

  • (a) Conditions pose a health or safety risk.
  • (b) Items are assessed as too fragile or damaged for treatment.
  • (c) The Customer refuses to sign a required waiver.

6.2 No liability is accepted for loss or delay caused by refusal under this clause.

7. Booking and Reservation Fees

7.1 To secure a service date, Customers must pay a 5% non-refundable, non-transferable booking fee.

7.2 This fee will be deducted from the final invoice.

8. Payment Terms

8.1 Full payment is due on completion of the Services unless otherwise agreed in writing.

8.2 Accepted payment methods: cash, card, or bank transfer.

8.3 Approved Customers may be invoiced at Muck Away’s discretion, with payment due within 7 days of invoice date.

8.4 A 15% late payment surcharge applies if payment is not made within 7 days.

8.5 Outstanding balances over 21 days may be referred to collections, with associated costs added.

8.6 All prices are exclusive of VAT unless otherwise stated.

8.7 Interest on overdue amounts may also be charged at 4% above the Bank of England base rate, plus recovery costs.

9. Cancellations and Rescheduling

9.1 Customers must give a minimum of 48 hours’ notice.

9.2 Cancellations within 48 hours may incur a charge of up to 50% of the quoted price.

9.3 Non-attendance without notice may be charged at the full quoted price.

9.4 Same-day cancellations (within 24 hours) may incur a charge of 50% of the quoted price.

10. Inspection and Satisfaction Guarantee

10.1 The Customer or representative must be present at the start and end of the work for inspection.

10.2 If not present, Muck Away’s inspection will be final, and no claims will be accepted after completion.

10.3 Any dissatisfaction must be reported within 24 hours by phone or email.

10.4 If valid, Muck Away may re-clean the area within 48 hours at its discretion.

10.5 Refunds may only be considered after a re-clean and if the Customer complied with obligations.

11. Limitations of Liability

11.1 Muck Away’s total liability shall not exceed the amount paid for the Services in question.

11.2 Muck Away shall not be liable for:

  • (a) Consequential, indirect, or special losses.
  • (b) Loss of value, profit, or use.
  • (c) Pre-Existing Damage or hidden defects.
  • (d) Issues from treatments outlined in Clause 4.3.
  • (e) Gradual wear, re-soiling, or deterioration occurring naturally.
  • (f) Issues caused by lack of electricity, hot water, or access.
  • (g) Re-soiling or damage by third parties (pets, children, etc.) after work.

12. Indemnity

12.1 The Customer shall indemnify Muck Away against all claims, costs, damages, and expenses arising from:

  • (a) Breach of these Terms by the Customer.
  • (b) Claims by third parties due to the Customer’s instructions, omissions, or negligence.

13. Rug Spa Services, Risks & Transportation

13.1 Scope of Services

Muck Away operates a specialist Rug Spa facility for the cleaning and restoration of rugs, including but not limited to dusting, immersion washing, stain removal, colour correction, controlled drying, deodorisation, fringe detailing, fibre protection, and moth treatment.

13.2 Inherent Risks

The Customer acknowledges that rug cleaning, restoration, and dyeing treatments carry inherent risks, including but not limited to:

  • (a) Dye migration, dye bleed, or colour instability.
  • (b) Shrinkage, rippling, or warping due to pre-existing construction weaknesses.
  • (c) Weak or degraded fibres or backing becoming further damaged during treatment.
  • (d) Reactivation of odours from historical contamination (e.g., pet urine, spills).
  • (e) Fringe damage, deterioration, or discolouration.
  • (f) Uneven colour appearance where fading, staining, or wear was pre-existing.
  • (g) Variations in colour outcome following dyeing or colour correction due to fibre type or original colour.

13.3 Customer Responsibilities

  • (a) Customers must disclose all known issues including prior cleaning, spillages, moth infestations, pet urine, or chemical treatments.
  • (b) Rugs must be uplifted and ready for collection unless otherwise agreed.
  • (c) Customers are responsible for advising of high sentimental or market value so appropriate risk assessments can be made.

13.4 Transportation Risks

  • (a) Where rugs are collected, transported, or returned by Muck Away or its couriers, Muck Away is not liable for transit delays.
  • (b) Muck Away is not liable for transit damage unless caused by its negligence.
  • (c) Customers are responsible for adequate packaging where applicable.

13.5 Exclusions

Muck Away shall not be liable for pre-existing damage, wear, fading, previous dye treatments, or hidden defects that become apparent during or after Rug Spa services.

14. Photographic Evidence

14.1 Muck Away may take before/after photographs for records, training, insurance, and marketing unless the Customer opts out in writing before the Start Date.

15. High-Risk Treatments – Acknowledgement

15.1 Prior to attempting advanced stain removal, bleach spot repair, colour correction, or dyeing, Muck Away may require a signed waiver acknowledging risks.

15.2 Refusal to sign may result in cancellation of the treatment without liability.

15.3 If treatment is commenced but discontinued due to professional judgment (unsuccessful or unsafe), the Customer agrees to pay a minimum charge of 10% of the agreed price to cover costs and materials.

16. Force Majeure

16.1 Muck Away shall not be liable for delay or failure to perform due to events beyond its control, including weather, illness, transport disruption, or supply shortages.

17. Governing Law

17.1 These Terms are governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

18. Acceptance of Terms

By booking Services with Muck Away, the Customer confirms they have read, understood, and accepted these Terms & Conditions. It is the Customer’s responsibility to review these Terms prior to booking.

19. Waiver & Acknowledgement

19.1 Where the Customer requests any carpet, upholstery and rug cleaning, including advanced stain removal, bleach spot repair, carpet/rug colour correction, or any other high-risk treatment, the Customer expressly acknowledges the following:

  • (a) Such treatments are not guaranteed to remove or correct stains, discolouration, or damage.
  • (b) The process may result in: permanent colour change or loss, altered texture or fibre distortion, shrinkage, rippling, warping, uneven appearance, or further visible damage to weakened fibres.
  • (c) Pre-existing or hidden damage may become more apparent after treatment.
  • (d) Refunds are not available where reasonable efforts were made in line with industry practice.

19.2 The Customer waives and releases Muck Away from liability for any dissatisfaction, damage, or loss of value caused by such treatments, save where damage is directly caused by proven negligence.

19.3 The Customer further acknowledges that if a treatment is commenced but discontinued due to professional judgment (unsuccessful or unsafe), a minimum charge of 40% of the agreed service price will apply.
